RACINE - An Illinois woman, stopped by Racine police after she was seen throwing an open beer can out the window of her car Thursday, was arrested for her 13th offense of drunk driving.

Dawn M. Oliva, 37, was taken into custody Thursday night. She was charged in Racine County Circuit Court Friday afternoon with a felony charge of operating while intoxicated 7th, 8th or 9th offense and a misdemeanor charge of disorderly conduct. If convicted, Oliva could face up to 10 years in prison.

The court has confirmed six prior OWI convictions from Illinois.

According to the criminal complaint, a Racine Police Officer saw a Mercury Marquis driving south on Dr. Martin Luther King Jr. Drive just before 5 p.m. The car started driving into the intersection at State Street against a red light, but then stopped.

Although the car was in the turn lane, when the light turned green, it continued straight on Dr. Martin Luther King Jr. Drive.

Reports said the officer was in the process of pulling the car over when she saw the driver throw an open beer can out of the driver's side window. The car then swerved and pulled over.

According to police reports, there were two women inside the car, Oliva and another woman she identified as her niece. Both appeared to be intoxicated and the officer could smell a strong odor of intoxicants coming from the vehicle.

When asked for a driver's license, Oliva told the officer she didn't have one. She said she had been stopped 11 or 12 times for operating under the influence.

Reports said the officer called dispatch to confirm the information, and when she returned to the car, Oliva was eating a salad from a bowl without utensils, placing her face in the bowl.

Police said Oliva was asked to step out of the car and perform field sobriety tests, but she refused, saying she was disabled.

Reports said she was then taken to Wheaton Franciscan-All Saints Hospital, 3801 Spring St. to have blood drawn. According to the complaint, Oliva became uncooperative and obnoxious, swearing at officers and calling them names.

Oliva was arrested for the OWI charge, disorderly conducted and given four traffic citations. She was taken to the Racine County Jail where she was held overnight on a $5,150 cash bond.

On Friday her bond was modified to $25,000. She was also ordered not to drive, or consume or possess any alcohol.
