Man arrested after allegedly beating mother, taking child

RACINE - For nearly four terrifying hours, Marcy Macemon lived through a parent's worst nightmare. Her little girl had been taken from her by force, allegedly by her boyfriend.

The man who allegedly had just beaten her snatched her 11½-month-old out of her arms and said she wouldn't see her again unless she paid him $2,000.

Macemon said she watched with horror as Torrey L. Smithiwer pushed her daughter down the street in a stroller, away from her home at 1900 Mead St., and disappeared. She called police, and then waited, in tears, for word about her baby.

Less than 30 minutes after an Amber Alert was issued, Khalasia Macemon was returned home unharmed. And Smithiwer, also known as Torrey Smith, 19, was in police custody.

Smithiwer allegedly took Khalasia at around 9:15 a.m. Friday, after Macemon told him their 1-month relationship was over. He beat Macemon and left with her little girl.

"He told me he was going to use my daughter," Macemon said. "He said I had to give him $2,000 to get my daughter back."

Smithiwer is not Khalasia's

father.

Bruised and worried, Macemon sat crying on the porch of her house Friday while she waited for any news on Khalasia. "I don't have that kind of money," she said. "I wish I could do something."

Smithiwer snatched Khalasia out of her arms, Macemon alleged. He took off with the baby in a blue stroller with white flowers on it. She said she saw him walk east on DeKoven Avenue, but lost sight of him while she called

police.

"He called his brother in Milwaukee," she said. Smithiwer told her he was going to have his brother pick him up and take him to the airport. "He said he's taking my daughter to Texas. That's where he's from."

Prior to the Amber Alert being issued, authorities were searching for Smithiwer. They notified the Milwaukee County Sheriff's Department because it was believed he may have been headed to General Mitchell International Airport.

Deputies at the airport alerted employees at all the ticket counters and shops. They were also posted at concourse entrances looking for the suspect.

After three hours of searching without success, the Amber Alert was issued at around 12:30 p.m. Police put out a description and photos of Khalasia and Smithiwer. Less than 30 minutes later, Khalasia was back home with her mom.

Smithiwer reportedly got scared when he saw the Amber Alert, and sent a woman to bring Khalasia back to her mother. Smithiwer was talking to the woman on a cell phone when she dropped the little girl off. Macemon said Smithiwer told her over the phone to have police cancel the alert.

"He said he got scared and so he brought her back," Macemon said. "I was so happy."

Macemon said as soon as she saw the woman pushing Khalasia around the corner in her stroller, she went and held her daughter. "I hugged and kissed her," she said. "She's OK."

A short time after Khalasia was returned to her mom, Smithiwer called Racine Police and

arranged to turn himself in to authorities. Police met him at the intersection of 14th and Villa streets and took him into

custody. Both the woman who brought Khalasia back to her mother and Smithiwer were then interviewed by police investigators. A police spokesman said Friday that they will conduct more interviews before charges are

issued.

Macemon said she believes that Smithiwer and her baby were probably at a home on Villa Street the entire time police were searching for them. She said Smithiwer has a cousin who lives there and she recognized the woman who returned her daughter as the girlfriend of Smithiwer's cousin.

According to online court records, Smithiwer has never been charged in Racine County for any type of crime.

In January, a Milwaukee woman filed a harassment restraining order against him for allegedly threatening her, taking her car and beating up another woman, according to court records. But the restraining order was dismissed on Jan. 15 after she failed to show up for a court appearance, records said.
